I just came across your blog and in Germany the story is told a little bit differently:

Legal aspects did not play a major role in the discussion. The main point was, that the contracts had been canceled unilaterally by SAP by sending a letter, as it is reported by the German press. Most of the customer had taken big investments in their SAP landscape running basically the whole company under SAP. So, the risk not to sign the new maintenance contract was very high. These customers, with a turnover between 1 and 10 billion Euro, reported on a press conference held in Düsseldorf on Dec. 10th, that they felt SAP is using this dependence. A further topic in the discussions was the reported decreasing quality of the support. And another was the required investment for the new tools that are necessary to make use of the Enterprise Support. So, in Germany the topic will very likely stay on the agenda.
