I own an Android/smartphone and have a legal licensed copy of Office Home and Student. Can I use Office on my phone to access my Word or Excel files from my home computer and how?

Only if you have the software on your smartphone that allows you to do an RDP session to your computer.  Once you install that, you should have no problems, but, you need to ensure that you allow the proper settings so that no one else can access your home PC.

Since you have an Andriod smart phone, I would think that the best option for you would be to upload your files to Google Docs and then use one of many apps for the phone that are compatible with Office to access the files from Google Docs.
