If you mean that a hacker has taken ownership you can simply regain ownership by right clicking the files and selecting SECURITY then Ownership, Take Ownership....assuming that this is a Microsoft operating system.
If it's a Linux OS then you need to do a <b>CHOWN -R *.*</b>

I agree. Once a hacker has your data, you have to assume that they will do something malicious with it. Contact the authorities and try to minimize the damage. For instance, if the files contained passwords, change the passwords.
It depends on what you want/need out of it. You may consider calling a forensics investigator as well. Your local HTCIA chapter will have qualified people who can help.
