The HITECH Act, as is now widely known, has had a dramatic impact on HIPAA compliance. Business associates as well as covered entities are now directly responsible for protecting personal health information, and the fines that these organizations face in the event of a data breach are significantly higher than they used to be. For that reason, privacy and security play a prominent role in the HITECH Act’s meaningful use criteria.
